Terms and Conditions of Use

Welcome to www.rgwilbreytraining.uk.com (the “Website”), operated by RG Wilbrey Training (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern Your use of our Website and the services we provide, including the booking and delivery of training, accredited by organisations such as NEBOSH, UKATA, CITB, IOSH, First Aid, and MHFA. By accessing or using our Website or Services, You agree to be bound by these Terms. If You do not agree, please do not use our Website or Services.

1. Definitions

• “Client” or “You”: Any individual or organisation accessing the Website or purchasing our services.
• “Services”: Training courses and related offerings provided by RG Wilbrey Training.
• “Training Bodies”: Accrediting organisations such as NEBOSH, UKATA, CITB, IOSH, First Aid, MHFA, and others.

2. Use of the Website

2.1. You must be at least 18 years old to use this Website or book our Services.
2.2. You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Website.
2.3. We reserve the right to suspend or terminate access to the Website or Services if You breach these Terms.

3. Booking and Payment

3.1. Course Bookings: All bookings for training courses are subject to availability and confirmation by RG Wilbrey Training. A contract is formed when we send You a booking confirmation via email.
3.2. Pricing: Prices for courses are as stated on the Website, exclusive of VAT unless otherwise specified. We reserve the right to amend prices at any time before booking confirmation.
3.3. Payment: Full payment is required at the time of booking unless otherwise agreed in writing.
3.4. Cancellations by You:
• If You cancel more than 14 days before the course start date, You may be entitled to a full refund.
• Cancellations within 14 days of the course start date may not be refundable, subject to clause 3.6.
3.5. Cancellations by Us: We reserve the right to cancel or reschedule a course due to insufficient bookings, trainer availability, or unforeseen circumstances. In such cases, we will offer a full refund or an alternative date, but we will not be liable for any additional costs incurred by You (e.g., travel expenses).
3.6. Consumer Rights: If You are a consumer (not booking on behalf of a business), You have a legal right to cancel within 14 days of booking under the Consumer Contracts Regulations 2013, provided the course has not yet started. To exercise this right, contact us at training@rgwilbrey.uk.com.

4. Delivery of Services

4.1. Courses will be delivered in accordance with the standards set by the relevant Training Bodies and client specification.
4.2. You must provide accurate information when booking and ensure delegates meet any eligibility criteria specified by us or the Training Bodies.
4.3. We reserve the right to refuse entry to a course if a delegate does not meet the required standards or behaves disruptively. For the avoidance of doubt, no refunds will be provided in such cases.

5. Intellectual Property

5.1. All content on the Website, including text, images, course materials, and logos, is owned by us or our licensors and is protected by UK copyright law.
5.2. You may not reproduce, distribute, or use any materials provided during our courses for commercial purposes without our prior written consent. For the avoidance of doubt, this consent can be revoked at any time should we deem it necessary.

6. Liability

6.1. We will provide our Services with reasonable care and skill, in line with the Consumer Rights Act 2015.
6.2. We are not liable for:
• Any loss or damage caused by Your failure to follow instructions or meet course prerequisites.
• Indirect or consequential losses (e.g., loss of profit, business interruption).
6.3. Our total liability to You for any claim arising from these Terms or our Services is limited to the amount paid by You for the relevant Service(s).
6.4. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any matter that cannot be excluded under UK law.

7. Data Protection

7.1. We process personal data in accordance with the UK GDPR and our GDPR, Privacy and Data Retention Policy – Version 2 – October 2024.
7.2. By booking a course, You consent to us sharing delegate information (e.g., names, results) with the relevant Training Bodies for certification purposes.

8. Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, strikes, or government restrictions.

9. Complaints

10. Governing Law and Jurisdiction

These Terms are governed by English law. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales, except where You are a consumer resident in Scotland or Northern Ireland, in which case You may bring proceedings in Your local courts.

11. Changes to These Terms

We may update these Terms from time to time. The latest version will be posted on the Website with the “Last Updated” date. Continued use of the Website or Services after changes constitute acceptance of the updated Terms.
